Conditions for registration from 18 years of age

In order to register, you may be asked to provide the following documents: - A valid proof of identity (Passport, Identity Card or Driving License) - A bank card with account number (name and account number must be visible) This information must correspond with the information entered on the registration form. The person who registers is aware of the fact that the numbers of these two documents can be stored digitally in the membership administration of Happy Bodies (hereinafter referred to as: HB).

Conditions for registration for minors aged 16 and over

A parent, or guardian appointed by law, must come along to register and sign the registration form. Furthermore, the above conditions apply (see conditions for registration from 18 years of age) with the additional condition: a valid ID of the parent, or guardian appointed by law, must be shown upon registration (Passport, Identity Card or Driving License). Minors under the age of 16 are not admitted as members of HB

HB offers various membership periods, namely: flexible, 12 and 24 months, where the prices shown differ per membership and apply per four-week payment period. Exceptions regarding membership form, price or duration of membership are determined by the management and are binding for the member, as is the agreed period of membership. For each registration, a pro rata amount is calculated for the remaining days of the registration month for the period of registration. With each registration, the member pays € 20 administration costs and € 99 for the starter package. For all membership types, the member can make unlimited use of all facilities within the Happy Bodies lifestyle clubs during the term of the agreement, except for a number of specific facilities/products. An additional fee is charged for these facilities/products. In the event of loss or damage to the pass/bracelet, which makes the pass/bracelet unusable, the member must purchase a new pass/bracelet. Each membership is a fixed-term agreement and will be extended after the first agreed minimum membership period for an indefinite period of 1 calendar month each time and can be canceled monthly from that moment on, taking into account the then applicable notice period.

In the event of a cancellation within the first agreed minimum membership period, which is submitted at least 1 full calendar month before the official end date of the fixed period, the official end date of this minimum membership period will be adhered to. Interim or premature termination is not possible, with the exception of moving outside a radius of 15 km outside the lifestyle club, and not coming to live within a radius of 15 km within one of the other Happy Bodies lifestyle clubs, which must be confirmed by proof of registration of the new municipality must be demonstrated. In the event of a cancellation submitted within 1 month before the expiry of the fixed membership period, or after the fixed membership period, a notice period of 1 full calendar month applies. Cancellation is only possible via the tablet in the club or in writing. Telephone and verbal cancellations are not accepted, nor are cancellations by email. You will receive the cancellation confirmation by e-mail from the membership administration upon correct deregistration, stating the end date of the membership.

In the event of injury or long-term illness, it is possible to freeze membership for a minimum duration of 4 weeks and a maximum duration of 12 weeks. For frostbite due to injury or long-term illness, written proof is required in the form of a doctor's certificate issued by a doctor working in the Netherlands confirming the injury/illness. If the treating physician does not issue this, it can be obtained from a non-treating physician, in accordance with the legal guidelines of the KNMG. The freeze always starts on the 1st of the new payment period after receipt of the doctor's certificate. Retroactive freezing is not possible. In the event of freezing, the membership end date is extended for the same period, including financial obligations for that period. Freezing does not apply to, for example, internships, work, studies or holidays, with the exception of holidays with a duration of at least 8 consecutive weeks, which must be made plausible by means of documentary evidence. During the freeze, the membership fee will continue to be paid, which will be corrected with "free" extra weeks after the member has notified HB if he improves (a maximum of 12 weeks will be compensated). After termination of a membership, any outstanding installments remain unaffected and must be paid immediately. The same applies to installments that are canceled after termination of a membership and associated cancellation costs. Regardless of whether or not you use HB's facilities, the customer remains obliged to meet the payment terms. The extent of use is separate from the payment obligation. HB reserves the right to refuse customers in the event of misconduct and to terminate memberships prematurely/immediately, whereby the obligation to pay until the end of the contract becomes suddenly due and remains unaffected.

Other general provisions

HB reserves the right to temporarily or permanently change one or more of the lifestyle clubs or parts thereof and to close the lifestyle clubs in whole or in part during public holidays, renovations, unforeseen circumstances, government decisions and internal training days, without refunding any costs. membership fees are possible. HB reserves the right to increase the rates annually. This increase does not give the right to terminate the membership, unless this increase amounts to more than 10% per year. Upon signing, the member declares to comply with the house rules drawn up by HB at all times and to be aware that if the house rules are broken, access to HB will be refused, which does not release the member from the payment obligation that entails the full contract term. brings. Membership is strictly personal and non-transferable. In the event of a change in contact and/or address details, the member is responsible for passing on this information. Any costs incurred due to failure to fulfill this responsibility will be borne by the member. HB is not liable for loss, embezzlement, theft or damage, either directly or indirectly, of or to goods of participants or third parties. HB is not liable for any accidents to members or those present in the building, nor for injuries caused, for example, by withholding medical information during registration or by incorrect use of the equipment or facilities. HB reserves the right to supplement or amend the General Terms and Conditions as well as the House Rules and other provisions. Changes hereto will be announced by means of a newsletter or e-mail, after which these rules and regulations will be binding on every member.

Method of payment

When registering via a registration form or tablet, the member undertakes to pay the membership amount due until the end of the contract. The end of a membership is determined by means of the cancellation procedure described in the General Terms and Conditions. By signing, you give permission to automatically debit the account number specified by the member, in accordance with the collection rules that are further described when approving the direct debit. Memberships are collected once every four weeks. The member therefore generally pays in advance. Payments other than direct debit for memberships are not possible. Under no circumstances will membership fees be refunded for prepaid installments.

When payment is not made

A maximum of one installment is collected per collection round, with the exception of the 1st collection upon registration. If no payment is made, the member will receive a letter or email containing the payment reminder. If this is not responded to again, you will receive a reminder with additional cancellation costs of €7.50 and associated administration costs. If this is complied with within the set payment term, collection will resume according to the established procedure. If the payment reminder is not responded to and/or is not paid on time, the total outstanding membership amount and any installments still to be invoiced until the end of the contract will become due and payable and will be handed over to the collection agency appointed by HB. The collection agency will send one more reminder letter. If the total outstanding amount is not paid, the collection agency will charge a minimum of €40 in collection costs and interest costs will be charged. These are at the expense of the member who must pay them together with the principal amount to the collection agency. After the member has been referred to the collection agency, use of HB's facilities is no longer possible. From that moment on, payments and general communication about membership must be made via the collection agency. Only when the full amount has been paid to the collection agency will the member be granted access to the lifestyle club again.

Other provisions

Dutch law applies to this agreement. If a provision of the membership and/or the general terms and conditions proves to be invalid, this will not affect the validity of the entire agreement. Acceptance of membership is subject to approval by the HB management. Any use of HB's facilities and amenities is at your own risk. Before using any facility or participating in any activity, every member must ensure that use/participation is medically responsible for him/her. Use of HB's facilities and amenities is only possible with clean indoor shoes and a towel. Failure to bring or use these items may result in exclusion from the club. The HB management will decide on provisions not provided for in these general terms and conditions. This decision is binding on the member
